LA REFORME DE LA COGESTION. UN COUP d'ARRET AU DECLIN DES SYNDICAT ?

Résumé

La réforme de la cogestion décidée par le gouvernementSchröder pour faire un geste en direction de son électorat degauche un an avant les élections au Bundestag vise à accroîtreles pouvoirs des conseils d'entreprise, notamment dans le domaine social,dans un pays où la cogestion est déjà parmi les plusétendues du monde. L'élément clé de la réforme,la simplification du processus électoral aux conseils d'entreprise,est destiné à accroître le nombre de conseils dans lesPME/PMI, permettant ainsi aux syndicats de s'implanter dans des entreprisesoù ils sont actuellement peu présents.

Die Reform des Betriebsverfassungsgesetzes, die die Regierung Schröderbeschlossen hat, um ein Jahr vor den Bundestagswahlen für ihre Wählerschaftein Zeichen zu setzen, hat zum Ziel, die Machtbefugnisse der Betriebsrätein einem Land auszuweiten, in dem die Mitbestimmungsrechte bereits zu denweitgehendsten der Welt gehören. Das Kernstück der Reform, dasvereinfachte Wahlverfahren für Unternehmen mit bis zu 50 Mitarbeitern,ist dazu bestimmt, die Anzahl der Betriebsräte in Kleinunternehmenzu erhöhen, was dazu führen kann, dass die Gewerkschaften in UnternehmenFuß fassen, in denen sie bis jetzt wenig vertreten sind.

Abstract

The reform of workers' councils decided by the German government in orderto please its leftist electorate a year before parliamentary elections aimsat extending the powers of workers' councils, particularly on social matters,in a country where joint management already belongs to the most extensiveof those systems in the world. The key element of the reform, the simplifiedelectoral process to designate councillors in companies with 50 workersor less is intended to increase the number of workers' representatives insmall enterprises. This can lead to trade unions taking root in companieswhere until now they are not much present.
